Waitangi Tribunal Hearings, Toll Stadium, Whangarei, Oct 4-6

I invite you and your whanau to attend the Waitangi Tribunal Hearing into the Crown’s recognition of the Ng
ātiwai Trust Board’s Treaty Settlement Mandate that is being held at Toll Stadium – 51 Okara Drive, Whangarei, next Tuesday, October 4, and concluding on Thursday, October 6.

A powhiri will be held Tuesday, October 4, 8.30am.  A brief morning tea will be provided following the powhiri.
Hearings will commence at 9.30am on Tuesday.  The following daily sessions will commence 9am, and finish at 5.30pm.

Waitangi Tribunal Hearings – Update from Chairman, Haydn Edmonds

Recently the Treaty Claims Committee and I invited all claimants involved in the upcoming Waitangi Tribunal hearing opposing the Crown’s recognition of Ngātiwai Trust Board’s Treaty Settlement Mandate to a hui to see if we could find a way forward, and ultimately unite in order to prosecute the Crown. 

While all those contacted initially said they were keen on the idea, only Carmen Hetaraka and Elvis Reti (by phone from Australia) attended, with the suggestions being that the others declined to attend  based on legal advice, given the upcoming hearing.

Discussions at this Hui were very positive and constructive, and I think they provide a good example of progress we could make if we were talking to each other kanohi ke te kanohi instead of through lawyers, the Crown and the Tribunal.

Among the topics discussed:
  • The need to advance discussions about the shape of a Ngātiwai Post Settlement Governance Entity (PSGE) ahead of a settlement, and how that entity can reflect and give our Mana Māori Motuhake.
  • The need for well resourced, rock solid research to underpin our negotiations and to educate our people, including looking at who is Ngātiwai, who lost what, and who took it and therefore who has the right to be talking.
  • The idea of establishing a Ngātiwai tribal taumata to maintain oversight over Board decisions was discussed and the progress of negotiations.
Our hui concluded with a commitment, based on the goodwill displayed, to workshop the PSGE at the next hui-a-iwi at Ngunguru and at future hui.

While the Board will continue to defend the Mandate, we are very open to working with all our claimants to develop a solid research basis for our claims, involving our people with their local issues and input before negotiations begin.  We will also support the idea of a Ngātiwai taumata, which we will work to establish before negotiations begin.

We are committed to holding more hui like the one recently held, and following through on those discussions.

Last month a Pou whenua was laid by our hapū at Mimiwhangata.  This Pou is called Manaia and he once again stands on the homeland of Ngātiwai. 

It was Manaia who set the boundaries of the Ngātiwai rohe with five Tohora being set in place.  It is the Moana that gives us mana, as well as the off shore islands which belong to us all.  The resources in our rohe belong to all of us, and have done so for generations.  I do not believe that these claims are about Ngātiwai versus Ngātiwai.  My fight is, and has always been, with the Crown.

Kia kaha Ngātiwai!  There is safety in numbers and the future is bright if we stand as one.  The Board is only a vehicle that can carry us all into negotiations with the Crown, and the outcome of those negotiations must benefit us all in the 21st century.  It will not be the Ngātiwai Trust Board who handles and manages the putea and resources we get back from the Crown as part of any settlement.  That will be the new PSGE, and what that looks like is up to you to decide.

To the claimants, kia kaha.  We will continue with an open door policy inviting continued kōrero and positive hui with you all.

We have already come home to Mimiwhangata with the planting of the Pou Manaia.  Together, let’s start from here to reclaim all that is ours.

Hapū make a stand at the homeland of Te Iwi O Ngatiwai

Te Pou whenua "Manaia"
On Saturday 20th August, a Pou whenua was erected at dawn in Mimiwhangata by the hapū and marae of Ngātiwai.  This Pou was raised to protest against and signal dissatisfaction with the Government’s proposed marine legislation at Mimiwhangata.

The pou, named Manaia, was carved by Ngātiwai Tohunga whakairo Te Warihi Hetaraka.  The name is significant, as Mimiwhangata is the ancestral homeland of Ngāti Manaia and Ngātiwai.

Whanau gathered at 4am in the early morning darkness at Mimiwhangata ready to unveil the Pou Manaia.  It was a cold and wet morning, but this did not deter whanau.  Around 120 people gathered, with hapū from all of Ngātiwai present, to mark this memorable day in history.

The karakia and korero were led by Aperahama Edwards, Hori Parata and Te Warihi Hetaraka, with all those present responding when Aperahama called “Ko wai te ingoa o tenei pou?  “Ko Manaia!”   This was said three times to affirm the name of the pou as Manaia.

After karakia, everyone took turns at touching or giving a hongi to Manaia, after which some beautiful korero, mihi mihi and waiata were had.  The day was completed with a hangi and whanaungatanga.

​Kaumātua Kathy Caldwell said “Today was such a lovely and special day for me.  When we all come together on a kaupapa such as this, it shows that all of Ngātiwai can be united as one.  The wairua that I felt today was beautiful.  I hope that today can be the beginning of Ngātiwai truly unifying together as an iwi.  The memories of today will stay with me forever.”

  • Aqua-cultural Settlement: - TOKM have advised the policies regarding the distribution of the aqua-cultural settlement are being rewritten. The funds will continue to be held for iwi not willing to sign however those that have signed may receive their distribution by March 2017.
  • Board Policy Review: - A committee will meet to commence the review of the NTB policy manual.
  • Consolidated Financials: - NTB group consolidated financials for month ended 30th June are running reasonably on budget.
  • Education: - The Education Unit is awaiting a response regarding the Manaaki marae proposal. The Ma te Reo contract is being delivered through Education unit as a series of 3 weekend wananga which commenced on Friday 19th August.
  • Governance and Management Training: - Trustees and staff attended a Governance and Management Training course during the month. The key topics were Governance, Management and Strategy, the programme was facilitated by the NZ Institute of Directors and sponsored by Te Puni Kokiri.
  • Honey: - Legal due-diligence is being completed on the NTB honey proposal/contract.
  • Hui-A-Iwi: - Arrangements are underway for the next Hui-A-Iwi on 9th and 10th of September at Ngunguru Marae.
  • Marae Insurance: - A brief presentation regarding Marae insurance was given by Jo Kiro from Kiro Insurance Claim Management Broker Servicing. Jo works one-on-one with marae and insurance underwriters to reduce their misunderstandings relating to insuring marae. She is happy to meet with Ngātiwai marae individually to discuss insurance options.
  • Marae Reports:
    • Kawa: - Quiet during the winter season. Kaumatua have had a series of discussions regarding unity.
    • Matapouri: - The marae is applying for basic funding with Foundation North to install a wheelchair ramp and complete other basic renovations. Also looking to purchasing a shipping container for extra mattress storage. The committee meets regularly to discuss marae and hapū matters especially relating to Ngātiwai treaty claims and the Ngāti Rehua settlement.
    • Mokau: - The rebuild is on schedule and target. The marae will be hosting a fund-raiser at the end of year.
    • Motairehe: - Funding applications are being secured to install power generators/solar units. Marae whanau are focusing on reaffirming and aligning with Ngātiwai kaupapa, a kaumātua meeting will be held shortly to discuss the topic of unity.
    • Ngaiotonga: - A defibrillation course was held during the month which was attended by 30 people. The marae has formed a sub-committee to assist with the community’s civil defense. Also a Rangitahi rōpu has been established to host activities at the marae, so far they have hosted recent events such as table tennis and indoor bowls.
    • Ngunguru: - No report.
    • Oakura: - The marae committee will be holding a meeting on 7th September to discuss ongoing maintenance, pest eradication, funding for mattresses and also reducing our NTB registered members GNA’s. The marae committee will also be selecting 3 whanau members to represent the marae on the Oakura Coastal Beachfront Reserve and Hall Committee and the wider Whangaruru Costal rate payers committee.
    • Otetao: - The marae is seeking funding to install extra storage space, improvements to the dining area and then the ablutions.
    • Omaha: - Marae bookings are still closed until October 2016. The next marae committee meeting is scheduled for next week.
    • Pataua: - No report.
    • Punaruku: - The marae committee is looking to gazette land behind the school for Punaruku marae, since the Whenua Topu Trust has declined our request to locate the marae at Waikaramihi.
    • Tuparehuia: - No report.
    • Whananaki: - Plans and a feasibility study to redevelop and upgrade the marae dining area and then ablutions are well underway. Also Whanau whero were honoured to be involved in the pou placement at Mimiwhangata which occurred on Saturday 20th August.
